By accessing or using HealthyAI's AI voice assistant services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Services.

These Terms apply to all users of the Services, including healthcare providers, practice administrators, and patients who interact with our AI voice assistant.

2. Description of Services

HealthyAI provides AI-powered voice assistant services designed specifically for healthcare practices, including:

  • Automated patient call handling and response
  • Appointment scheduling, rescheduling, and cancellation
  • Basic medical information and practice information queries
  • Prescription refill request management
  • Integration with practice management and EHR systems
  • After-hours patient communication support

3. Eligibility and Account Registration

Our Services are intended for use by licensed healthcare providers and their authorized staff. By using our Services, you represent and warrant that:

  • You are a licensed healthcare provider or authorized representative
  • You have the authority to bind your healthcare practice to these Terms
  • All information you provide is accurate and complete
  • You will maintain the security of your account credentials

4. HIPAA Compliance and Medical Disclaimers

HIPAA Compliance

HealthyAI is fully HIPAA compliant. We have entered into Business Associate Agreements (BAAs) with our healthcare provider clients and maintain all required safeguards for protected health information (PHI).

Medical Disclaimers

IMPORTANT: HealthyAI's AI voice assistant is not intended to provide medical advice, diagnosis, or treatment. The AI assistant:

  • Cannot replace professional medical judgment
  • Should not be used for medical emergencies
  • Provides administrative and informational support only
  • Always escalates medical concerns to licensed healthcare providers

5. User Responsibilities

Healthcare providers using our Services agree to:

  • Ensure proper configuration and oversight of the AI assistant
  • Review and approve all automated responses and actions
  • Maintain appropriate clinical oversight of patient interactions
  • Comply with all applicable healthcare regulations and standards
  • Promptly report any system issues or patient concerns
  • Ensure staff are properly trained on the system's capabilities and limitations

6. Prohibited Uses

You may not use our Services to:

  • Provide medical diagnosis or treatment recommendations
  • Handle true medical emergencies without immediate escalation
  • Violate any healthcare regulations or patient privacy laws
  • Attempt to circumvent system security measures
  • Use the service for any unlawful purpose
  • Interfere with or disrupt the integrity of our Services

7. Service Availability and Support

We strive to provide 99.9% uptime for our Services, but cannot guarantee uninterrupted access. We provide:

  • 24/7 technical support for critical issues
  • Regular system maintenance and updates
  • Backup and disaster recovery procedures
  • Performance monitoring and optimization

8. Limitation of Liability

To the fullest extent permitted by law, HealthyAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, incurred by you or any third party, whether in an action in contract or tort, even if we have been advised of the possibility of such damages.

Healthcare providers maintain full responsibility for all clinical decisions and patient care.

9. Indemnification

You agree to defend, indemnify, and hold harmless HealthyAI and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Services or violation of these Terms.

10. Termination

Either party may terminate these Terms at any time with 30 days written notice. Upon termination:

  • Your access to the Services will be discontinued
  • We will securely delete or return your data as requested
  • All outstanding fees become immediately due
  • Provisions regarding liability and indemnification shall survive

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through our Services. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.
